1. These Terms of Service define the rules for providing electronic services by Damian Stec, Niwki 40, 33-210 Niwki, Poland, Tax ID (NIP): 8711776934 (hereinafter: "Service Provider"), through the WeWishYou website available at zyczymy-zyczymy.pl (hereinafter: "Service").
2. These Terms constitute an integral part of the service agreement concluded between the Service Provider and the User.
3. Using the Service constitutes acceptance of these Terms.
4. The Terms are made available free of charge on the Service website in a form that allows downloading, saving, and printing.
1. The Service Provider provides the following electronic services through the Service:
2. The detailed scope of services included in individual Packages is defined in the pricing table available on the Service website.
3. The Service Provider reserves the right to change the scope of offered Packages, provided that changes do not affect already purchased Packages.
The following are required to use the Service:
1. The service agreement is concluded upon successful payment for the selected Package.
2. After payment confirmation, the Organizer receives access to the admin panel and can create an Event.
3. The Service Provider commits to activating the Package immediately, no later than 24 hours from payment confirmation.
4. The agreement is concluded for a fixed term corresponding to the Service availability period for Guests, as defined in the selected Package.
1. Services are provided for a fee, in accordance with the current pricing available on the Service website.
2. The Package fee is a one-time payment — no subscriptions or recurring charges.
3. Current gross prices (including applicable taxes) for Packages:
4. Payments are processed through the payment gateway. The Service Provider does not store payment card data.
5. The Service Provider issues an invoice upon User request.
Applies only to Consumers concluding a distance contract.
1. The Consumer has the right to withdraw from the distance contract within 14 days from the date of its conclusion, without stating reasons.
2. Exception: The right of withdrawal does not apply if the Consumer has given explicit consent to the commencement of digital service provision before the expiry of the 14-day period and has acknowledged the loss of the right to withdraw.
3. To exercise the right of withdrawal, the Consumer should send an unambiguous statement (e.g., by email to: kontakt@zyczymy-zyczymy.pl) before the expiry of the specified period.
4. In the event of effective withdrawal, the Service Provider refunds all payments received immediately, no later than 14 days from the date of receiving the withdrawal statement.
1. The User agrees to use the Service in compliance with applicable law, the provisions of these Terms, and good practices.
2. The User specifically agrees not to post content on the Service that:
3. The Organizer is responsible for content shared by Guests within their Event.
4. The User agrees not to share login credentials with third parties.
1. All rights to the Service, including copyrights to the code, graphics, interface, and content created by the Service Provider, belong to the Service Provider or entities to whom the Service Provider has granted appropriate licenses.
2. The User retains all copyrights to Content they post on the Service (photos, wishes).
3. By posting Content on the Service, the User grants the Service Provider a non-exclusive, free-of-charge, territorially limited license to use the Content solely for the purpose of proper service provision.
4. After the data retention period expires or the account is deleted, the license expires.
1. The Service Provider exercises due diligence in ensuring proper operation of the Service but does not guarantee its uninterrupted availability.
2. The Service Provider is not liable for:
3. The Service Provider's liability to non-Consumer Users is limited to the value of the purchased Package.
4. With regard to Consumers, mandatory provisions of applicable law concerning liability for defects shall apply.
1. The User may file a complaint regarding services provided within the Service:
2. The complaint should contain: User identification data, a description of the problem, and the expected resolution.
3. The Service Provider processes complaints within 14 calendar days from the date of receipt and informs the User of the result through the channel via which the complaint was submitted.
4. The Consumer has the right to use out-of-court dispute resolution methods. Information about procedures is available on the website of the Office of Competition and Consumer Protection: www.uokik.gov.pl. ODR platform: ec.europa.eu/consumers/odr.
1. The Organizer may at any time delete their Event and account by contacting the Service Provider at: kontakt@zyczymy-zyczymy.pl.
2. After the photo retention period defined in the selected Package expires, Guest data (photos, wishes) is automatically deleted.
3. The Service Provider may terminate the agreement with the User with immediate effect in the event of a gross violation of these Terms, particularly posting content that is unlawful.
1. The Service Provider reserves the right to change these Terms for important reasons, in particular: changes in legislation, changes in the scope or method of service provision.
2. The Service Provider will inform Organizers of changes to the Terms by email (to the address provided during registration) at least 14 days in advance.
3. Changes do not affect Packages purchased before the change takes effect.
1. Matters not regulated by these Terms shall be governed by applicable law, in particular the provisions of Polish civil law and applicable EU regulations.
2. Any disputes between the Service Provider and a non-Consumer User shall be resolved by the court having jurisdiction over the Service Provider's registered office.
3. With regard to Consumers, jurisdiction shall be determined in accordance with applicable civil procedure provisions.
4. The invalidity or ineffectiveness of any provision of these Terms shall not affect the validity of the remaining provisions.
